Welcome to Disc Rugs ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website at discrugs.shop (the "Site") and your purchase of products and services from Disc Rugs.

By placing an order on our Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or purchase our products.


1. GENERAL TERMS

1.1 Agreement to Terms
By accessing or using our Site and services, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using our Site on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

1.3 Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.


2. PRODUCTS AND ORDERS

2.1 Product Descriptions
We make every effort to display our rugs and products as accurately as possible. However, we cannot guarantee that your device's display of colors, textures, or designs will be completely accurate. All products are made to order and may have slight variations from images shown on the Site.

2.2 Pricing
All prices are listed in U.S. Dollars (USD) and are subject to change without notice. We reserve the right to correct any pricing errors on our Site. If we discover a pricing error after you have placed an order, we will notify you and give you the option to proceed at the correct price or cancel your order for a full refund.

2.3 Order Acceptance
Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, suspected fraud, or violations of these Terms.

2.4 Made-to-Order Products
All rugs are custom made to order. Production time is typically 7-10 business days. Once production is complete, shipping time is an additional 7-10 business days. Total delivery time from order placement to receipt is typically 14-21 business days, though actual times may vary.


3. VIP MEMBERSHIP SUBSCRIPTION

3.1 AUTOMATIC ENROLLMENT
IMPORTANT: BY COMPLETING ANY PURCHASE ON OUR SITE, YOU ARE AUTOMATICALLY ENROLLED IN THE DISC RUGS VIP MEMBERSHIP ("VIP Membership") AND WILL BE CHARGED A RECURRING MONTHLY FEE OF $34.99 UNLESS YOU CANCEL BEFORE YOUR TRIAL PERIOD ENDS.

3.2 Free Trial Period
Your VIP Membership includes a 14-day FREE trial period starting from the date of your first purchase. You will NOT be charged the $34.99 membership fee during this 14-day trial period.

3.3 Recurring Billing
After your 14-day free trial ends, you will be automatically charged $34.99 per month on a recurring basis. The billing cycle begins on the date your trial period ends and continues monthly until you cancel.

Example:

  • Order placed: February 1, 2026
  • Free trial period: February 1 - February 14, 2026
  • First VIP charge: February 15, 2026 ($34.99)
  • Second VIP charge: March 15, 2026 ($34.99)
  • And so on, monthly...

3.4 VIP Membership Benefits
Your VIP Membership includes:

  • Exclusive discounted pricing on ALL products
  • Priority shipping on all orders
  • Priority access to new product launches via Email
  • Priority notifications for sales and special offers
  • Priority 24/7 customer support

3.5 Cancellation of VIP Membership
You may cancel your VIP Membership at any time through one of the following methods:

  1. Email: Send a cancellation request to support@discrugs.shop
  2. Contact Form: Submit a cancellation request through the contact form on our website at discrugs.shop/contact

YOU MUST CANCEL BEFORE YOUR NEXT BILLING DATE TO AVOID BEING CHARGED. Cancellations must be submitted at least 48 hours before your next billing cycle to ensure processing. Once cancelled, you will retain VIP benefits until the end of your current billing period, but you will not be charged again.

3.6 No Refunds for VIP Membership Fees
VIP Membership fees are non-refundable. If you cancel your membership, you will not receive a refund for the current billing period, but you will not be charged for future periods.

3.7 Changes to VIP Membership
We reserve the right to modify the VIP Membership fee, benefits, or terms at any time. We will provide you with at least 30 days' notice of any material changes. Your continued use of the VIP Membership after changes take effect constitutes your acceptance of the new terms.


4. PAYMENT

4.1 Payment Methods
We accept major credit cards, debit cards, and other payment methods as displayed at checkout. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge all fees incurred.

4.2 Authorization
By placing an order, you authorize us to charge your payment method for:

  1. The purchase price of products ordered
  2. Applicable shipping fees
  3. Applicable taxes
  4. Recurring VIP Membership fees of $34.99 per month (after the 7-day free trial)

4.3 Payment Processing
All payments are processed securely through our third-party payment processor. We do not store your complete payment card information on our servers.

4.4 Failed Payments
If your payment method fails or is declined, we reserve the right to suspend or cancel your order and/or VIP Membership. For VIP Membership, we may attempt to process payment up to three times. If payment continues to fail, your membership may be cancelled.


5. SHIPPING AND DELIVERY

5.1 Shipping Timeframes

  • Production Time: 7-10 business days (custom made-to-order)
  • Shipping Time: 7-10 business days after production
  • Total Delivery Time: 14-21 business days from order placement

Actual delivery times may vary based on production schedules, shipping destination, and circumstances beyond our control.

5.2 VIP Expedited Shipping
VIP Members receive expedited shipping, which prioritizes their orders in production and uses faster shipping methods. VIP orders typically arrive 3-5 business days sooner than standard orders.

5.3 Shipping Costs
Shipping costs are calculated at checkout based on your location and order size. VIP Members receive discounted or free shipping on qualifying orders.

5.4 International Shipping
We currently ship only within the United States. International shipping may be available in the future.

5.5 Risk of Loss
All products are shipped FOB shipping point, meaning risk of loss and title pass to you upon delivery to the shipping carrier.

5.6 Tracking Information
You will receive tracking information via email once your order ships. You are responsible for monitoring your shipment and arranging to receive delivery.


6. RETURNS AND REFUNDS

6.1 Return Eligibility
You may return products for a refund within 14 days of receiving your order, provided the products meet ALL of the following conditions:

  • Unused and in original condition
  • Not stepped on or walked on
  • Clean and free from dirt, stains, or damage
  • In original packaging with all tags and labels attached

6.2 Return Process
To initiate a return:

  1. Contact us at support@discrugs.shop within 14 days of receipt
  2. Include your order number and reason for return
  3. Wait for return authorization and instructions
  4. Ship the product back using a trackable shipping method

6.3 Return Shipping
You are responsible for return shipping costs unless the product is defective or we made an error. We recommend using a trackable shipping service as we are not responsible for items lost or damaged in return transit.

6.4 Refund Processing
Once we receive and inspect your returned product, we will process your refund within 5-10 business days. Refunds will be issued to the original payment method. Please note:

  • Shipping costs are non-refundable (except for defective products or our errors)
  • VIP Membership fees are non-refundable
  • Custom or personalized products are non-refundable

6.5 Non-Returnable Items
The following items cannot be returned:

  • Products that show signs of use or wear
  • Products not in original packaging
  • Products damaged by misuse or accident
  • Custom or personalized products (unless defective)
  • Sale or clearance items marked as final sale

6.6 Defective or Damaged Products
If you receive a defective or damaged product, contact us immediately at support@discrugs.shop with photos of the damage. We will provide a prepaid return label and issue a full refund or replacement at no additional cost.


7. INTELLECTUAL PROPERTY

7.1 Ownership
All content on the Site, including but not limited to text, graphics, logos, images, product designs, and software, is the property of Disc Rugs or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

7.2 Limited License
You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Site without our express written permission.

7.3 Product Designs
All rug designs, patterns, and artwork are proprietary to Disc Rugs. Unauthorized reproduction, copying, or use of our designs is strictly prohibited and may result in legal action.


8. USER CONDUCT

8.1 Prohibited Activities
You agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Site's operation
  • Submit false or misleading information
  • Impersonate any person or entity
  • Transmit viruses, malware, or harmful code
  • Harvest or collect user information
  • Use automated systems or bots to access the Site

8.2 Account Security
If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.


9. PRIVACY

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Site, you consent to our Privacy Policy.


10. DISCLAIMERS

10.1 AS-IS Basis
THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Guarantee
We do not warrant that:

  • The Site will be uninterrupted, secure, or error-free
  • Defects will be corrected
  • The Site is free from viruses or harmful components
  • Results from using the Site will be accurate or reliable
  • Product quality will meet your expectations (beyond our return policy)

10.3 Color and Appearance
Due to variations in device displays and the handmade nature of our products, we cannot guarantee that colors, textures, or designs will appear exactly as shown on the Site or match your expectations.


11. LIMITATION OF LIABILITY

11.1 Limited Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISC RUGS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11.2 Maximum Liability
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SITE OR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11.3 Exceptions
Some jurisdictions do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers or limitations may not apply, and you may have additional rights.


12. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Disc Rugs and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  1. Your use of the Site or products
  2. Your violation of these Terms
  3. Your violation of any third-party rights, including intellectual property rights
  4. Any dispute between you and another user

13. DISPUTE RESOLUTION

13.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

13.2 Informal Resolution
Before filing a formal claim, you agree to contact us at support@discrugs.shop to attempt to resolve any dispute informally. We will attempt to resolve the dispute through good-faith negotiations within 30 days.

13.3 Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

If we cannot resolve a dispute informally, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules, except as modified by this section.

The arbitration will be conducted in Delaware, or at another mutually agreeable location, by a single arbitrator. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

YOU AGREE TO ARBITRATE DISPUTES ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION.

13.4 Exceptions to Arbitration
Either party may seek injunctive or equitable relief in court to protect intellectual property rights or confidential information. Additionally, either party may bring a claim in small claims court if the claim qualifies.

13.5 Opt-Out of Arbitration
You may opt out of this arbitration agreement by sending written notice to Disc Rugs at Dover, Delaware, 19901 within 30 days of your first purchase. Your notice must include your name, address, order number, and a clear statement that you wish to opt out of the arbitration agreement. If you opt out, you and Disc Rugs agree to resolve disputes in the state or federal courts located in Delaware.

13.6 Venue
If arbitration does not apply (including if you opt out), you agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.


14. MISCELLANEOUS

14.1 Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Disc Rugs regarding your use of the Site and supersede all prior agreements and understandings.

14.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

14.3 Waiver
Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative of Disc Rugs.

14.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section shall be void.

14.5 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights.

14.6 Force Majeure
We shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, labor disputes, supply chain disruptions, pandemics, or government actions.

14.7 Survival
The following sections shall survive termination of these Terms: Sections 3.6 (No Refunds), 7 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), 13 (Dispute Resolution), and 14 (Miscellaneous).

16. ACKNOWLEDGMENT

BY PLACING AN ORDER ON OUR SITE, YOU ACKNOWLEDGE THAT:

  1. You have read and understood these Terms of Service in their entirety
  2. You agree to be bound by these Terms
  3. You understand that each purchase automatically enrolls you in the VIP Membership with a 7-day free trial, followed by recurring monthly charges of $34.99
  4. You understand that you must cancel your VIP Membership before your trial ends to avoid being charged
  5. You understand our return policy and agree to its terms
  6. You consent to receive email communications regarding your orders and VIP Membership
  7. You agree to the arbitration provisions and waive your right to participate in class actions

If you do not agree to these Terms, do not place an order on our Site.
